Welcome to Formidable GTM™. These Terms of Use (“Terms”) govern your access to and use of the Formidable GTM website, platform, assessments, reports, and related products and services provided by Formidable Marketing, LLC, doing business as Formidable GTM (“Formidable GTM,” “we,” “us,” or “our”).
By accessing or using Formidable GTM, you agree to these Terms. If you do not agree, please do not use our website or products.
Use of Formidable GTM
Formidable GTM provides GTM revenue intelligence designed to help organizations assess their go-to-market foundation, identify opportunities and risks affecting revenue performance, prioritize areas of focus, and support revenue planning and execution. You agree to use Formidable GTM only for lawful business purposes and in accordance with these Terms.
Accounts and Information You Provide
Certain Formidable GTM products may require you to create an account or provide business information. You agree to provide accurate and current information and to maintain the confidentiality of your account credentials. You are responsible for information submitted through your account and for activity occurring under your account.
Assessments, Scores, Analysis and Reports
Formidable GTM may generate assessments, scores, analyses, recommendations, priorities, reports, and other outputs based on information you provide and analysis performed by the Formidable Revenue Intelligence Engine™. These outputs are intended to provide business intelligence and decision support. Their relevance and usefulness depend in part on the accuracy, completeness, and context of the information provided by the user.
Formidable GTM does not guarantee specific business, revenue, investment, sales, marketing, or other results from the use of its products or recommendations.
Artificial Intelligence
Formidable GTM uses artificial intelligence and automated technologies as components of its Revenue Intelligence Engine™. AI-generated and automated analysis may contain errors, omissions, or interpretations that are not appropriate for every organization or circumstance. Users are responsible for evaluating Formidable GTM outputs in the context of their own business and exercising appropriate judgment before making business decisions.
Not Professional Advice
Formidable GTM provides business intelligence and strategic decision support. It does not provide legal, accounting, tax, investment, financial, or other regulated professional advice. You should obtain appropriate professional advice when decisions require expertise in those areas.
Intellectual Property
The Formidable GTM website, platform, methodology, assessments, scoring systems, analysis frameworks, reports, software, designs, graphics, text, trademarks, and other proprietary materials are owned by or licensed to Formidable Marketing, LLC and are protected by applicable intellectual property laws. Formidable GTM™, Formidable Score™, and Formidable Revenue Intelligence Engine™ are trademarks of Formidable Marketing, LLC. Except as expressly permitted, you may not copy, reproduce, distribute, modify, reverse engineer, resell, publish, or create derivative works from Formidable GTM products, methodologies, assessments, reports, or other proprietary materials.
Your Reports and Business Information
You may use reports and other outputs generated specifically for your organization for your own internal business purposes. You retain ownership of business information you provide to Formidable GTM. Your submission of information gives us permission to process that information as reasonably necessary to provide and improve the Formidable GTM products and services, subject to our Privacy Policy.
Acceptable Use
You may not use Formidable GTM to interfere with the operation or security of the platform, attempt unauthorized access to systems or accounts, misuse or circumvent access controls, reproduce or systematically extract proprietary content, or use the platform in violation of applicable law.
Third-Party Services
Formidable GTM may rely on or integrate with third-party technology and service providers. We are not responsible for third-party products, services, websites, or systems that are outside our control.
Availability and Changes
We may modify, update, suspend, or discontinue portions of Formidable GTM from time to time as the platform evolves. We may also update these Terms periodically. Continued use of Formidable GTM following an update constitutes acceptance of the revised Terms where permitted by applicable law.
Disclaimer of Warranties
To the extent permitted by law, Formidable GTM and its products and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted or error-free or that any assessment, analysis, recommendation, or other output will produce a particular business result.
Limitation of Liability
To the fullest extent permitted by applicable law, Formidable Marketing, LLC and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Formidable GTM. To the extent permitted by law, our aggregate liability arising from or relating to Formidable GTM will not exceed the amount you paid to Formidable GTM for the applicable product or service giving rise to the claim during the twelve months preceding the event giving rise to liability.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
